These Terms of Service ("Terms") govern your use of the CaseIndex application, website, and related services (collectively, "CaseIndex" or the "Service"), provided by Discrete Log Technologies Pvt Ltd ("we," "us," or "our").
By creating an account, registering a clinic, or accessing our Service, you agree to be bound by these Terms. If you are registering an account on behalf of a clinic, hospital, or practice group, you represent that you have the authority to bind that entity to these Terms.
Direct Data Ownership
CaseIndex is designed to keep you in control. Your patient files, logs, and calendars reside directly within your own Google Workspace account. You are responsible for maintaining your active relationship with Google to ensure uninterrupted access to your files.
1. Eligibility & Geographic Limit
CaseIndex is offered and intended exclusively for medical professionals, clinics, and healthcare practices operating within the territory of India. By using CaseIndex, you warrant that your practice is legally registered in India and that your clinical activities comply with all relevant Indian healthcare regulations.
2. Account Registration & Security
To use our Service, you must create a secure account. You agree to:
- Provide accurate, current, and complete details during signup.
- Maintain the security and confidentiality of your credentials.
- Be fully responsible for all activities occurring under your clinic’s account, including actions taken by your added doctors, receptionists, or administrative staff.
3. Third-Party Integrations (Google Workspace)
CaseIndex operates as an integration layer connecting your local devices to your Google Workspace account (Google Calendar, Drive, and Sheets). By using the Service, you acknowledge and agree that:
- You must maintain an active Google account with sufficient storage space to hold your patient records and calendars.
- Discrete Log Technologies Pvt Ltd has no control over Google's service availability, account policies, or data limits.
- We are not liable for any service interruptions, data synchronization delays, or account suspensions originating from Google Cloud Platforms.
4. Patient Communications (WhatsApp & SMS)
CaseIndex enables clinics to trigger automated appointment confirmations and updates to patients via SMS or the WhatsApp Business Platform. You are solely responsible for ensuring that you have obtained the appropriate consent from your patients to send them automated transactional notifications on their registered mobile numbers.
5. Fair Use & Prohibited Activities
You agree not to use CaseIndex to:
- Transmit spam, unsolicited commercial advertisements, or deceptive patient alerts.
- Attempt to bypass, hack, or compromise the multi-tenant data isolation security of our servers.
- Use the platform for any illegal medical practice or in violation of local Indian healthcare laws.
6. Subscription & Payments
Certain features or usage tiers of CaseIndex may require a paid subscription. All pricing, billing periods, and payment terms are detailed separately in your account dashboard. Paid subscriptions are non-refundable, except as explicitly required by law or outlined in our refund policies.
7. Disclaimer of Warranties
CaseIndex is provided to you on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not warrant that the Service will be completely uninterrupted, error-free, or that patient slots will sync instantly under poor internet conditions.
8. Limitation of Liability
To the maximum extent permitted by law, Discrete Log Technologies Pvt Ltd shall not be liable for any direct, indirect, incidental, or consequential damages arising out of your use of the Service. This includes, but is not limited to, lost clinic practice hours, missed patient appointments, clinical record loss within your Google account, or any medical liability arising from your treatment of patients.
9. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any legal disputes or claims arising out of these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Pune, Maharashtra, India.
